Terms of Service

The following definitions apply to these Terms and Conditions. Words defined in the singular include the plural and vice versa.

• "Rarecandy," "we," "us," or "our" refers to the operator of the Rarecandy marketplace.
• "Website" refers to the Rarecandy website, currently accessible at https://rarecandy.mobcraft.org.
• "Service" refers to the Website, account functionality, product delivery system, and other services provided by Rarecandy.
• "Product" refers to any digital product, including but not limited to Minecraft mods, plugins, configurations, files, or other digital content offered for purchase through the Website.
• "Purchase" refers to an order placed by you for one or more Products through the Website.
• "Account" refers to the account associated with your Discord account and used to access Rarecandy services and purchased Products.
• "Device" means any device capable of accessing the Service, including a computer, mobile phone, or tablet.
• "Third-Party Service" means any service, platform, website, software, or content operated by a third party that is used in connection with or made available through the Service.
• "You" or "your" refers to the individual accessing or using the Service, or the company or other legal entity on whose behalf that individual is accessing or using the Service, where applicable.

Your access to and use of the Service is conditioned upon your acceptance of these Terms and our Privacy Policy.

By accessing the Website, creating an Account, or purchasing a Product, you acknowledge that you have read, understood, and agreed to these Terms.

You must be at least 18 years old, or the age of legal consent in your jurisdiction, to independently use the Service and make purchases. If you are under the applicable age, you may only use the Service with the involvement and consent of a parent or legal guardian who accepts responsibility for your use of the Service and any purchases made.

You are also responsible for complying with any applicable laws and the terms of any Third-Party Services that you use in connection with Rarecandy.

If you do not agree to these Terms, you may not access or use the Service.

Purchasing Products requires signing in with Discord.

You are responsible for maintaining the security of your Discord account and for all activity performed through your Rarecandy Account.

You must provide accurate information when using the Service and must not impersonate another person or entity or use a name, trademark, or other identifier that you do not have the right to use.

You must comply with Discord's Terms of Service when using Discord in connection with Rarecandy.

You must notify us promptly if you become aware of unauthorized access to your Account or any other security issue affecting your Account.

We reserve the right to refuse service, suspend or terminate Accounts, remove content, or cancel transactions where we reasonably believe that a user has violated these Terms, engaged in fraud or abuse, or otherwise misused the Service.

Products sold through Rarecandy are digital goods. Product descriptions, screenshots, compatibility information, version information, and other information displayed on the Website are intended to describe the Product being offered.

You are responsible for reviewing the Product description and compatibility requirements before purchasing.

Unless expressly stated otherwise, purchasing a Product does not transfer ownership of the Product or any associated intellectual-property rights to you. Instead, you receive the limited license described in Section 8.

We may update, modify, replace, discontinue, or remove Products from the Website at any time.

All prices are displayed in the currency shown during checkout.

Payments are processed through PayPal or other payment providers that we may make available in the future.

The price applicable to your Purchase is the price displayed at the time the Purchase is completed. Prices may change at any time without notice, but such changes will not alter the price of a completed Purchase.

We reserve the right to refuse or cancel an order where reasonably necessary, including where we suspect fraud, unauthorized activity, payment manipulation, pricing errors, or violations of these Terms.

If an order is cancelled by us before delivery, any refund will be handled in accordance with applicable law and the circumstances of the cancellation.

Due to the nature of digital products, sales are generally final once a Product has been delivered or made available for download.

We generally do not provide refunds for:

• Change of mind after purchase.
• Accidental purchases.
• Failure to review a Product's description or compatibility requirements before purchasing.
• Incompatibility with your particular device, software configuration, Minecraft version, server configuration, or other environment.
• Loss, suspension, or termination of access to your Discord account.
• Account bans or other actions taken by Discord or another Third-Party Service.
• Failure to use a Product after purchasing it.

However, nothing in these Terms is intended to exclude or limit any rights or remedies that cannot lawfully be excluded or limited under applicable law.

If a Product is materially defective, substantially different from its advertised description, or cannot reasonably be delivered as promised, please contact us through our Discord server. At our discretion, and where appropriate, we may provide technical assistance, a replacement, a corrected version, or a refund.

Any refund or remedy provided by Rarecandy is subject to applicable law and does not create an obligation to provide the same remedy in every future case.

After successful payment confirmation, Products are delivered through the Rarecandy delivery system, including the /download command in our Discord server where applicable.

Delivery requires a valid and appropriately linked Discord Account.

You are responsible for ensuring that your Discord Account is accessible and correctly linked to your Rarecandy Account.

We are not responsible for delivery failures caused by:

• Incorrect account information.
• Loss or suspension of your Discord Account.
• Failure to maintain access to Discord.
• Third-party service outages.
• Internet connectivity issues.
• Other circumstances outside our reasonable control.

If you experience a legitimate delivery problem, contact us through our Discord server so that we can investigate the issue.

Unless a Product's description states otherwise, each Purchase grants you a limited, non-exclusive, non-transferable, revocable license to use the purchased Product on one Minecraft server that you own or operate.

A single Purchase does not grant you the right to use the Product on multiple separate Minecraft servers. Each separate Minecraft server requires its own valid license unless a Product's individual license terms explicitly state otherwise.

The license does not transfer ownership of the Product or its underlying intellectual-property rights.

Unless expressly permitted by Rarecandy, you may not:

• Redistribute, resell, share, leak, or publicly release purchased files.
• Re-upload Products to other websites, marketplaces, file hosts, or distribution platforms.
• Give purchased files to another person for their use.
• Claim ownership of the Product or its source material.
• Remove copyright, attribution, license, or other ownership notices.
• Decompile, reverse engineer, or modify a Product for the purpose of concealing its origin or circumventing licensing or access controls.
• Use a Product in a manner that violates applicable law or the rights of Rarecandy or third parties.

The license is granted specifically to the purchaser and may not be transferred to another person, server owner, or organization without our prior written permission.

All Products, Website content, branding, logos, designs, documentation, software, and other materials provided by Rarecandy are owned by Rarecandy or their respective licensors, unless otherwise stated.

Purchasing a Product grants you a license to use that Product under these Terms; it does not constitute a sale or transfer of copyright, trademark rights, source-code ownership, or other intellectual-property rights.

You may not use Rarecandy's branding, logos, or other protected materials in a manner that suggests sponsorship, endorsement, partnership, or affiliation without our prior written permission.

You agree not to use the Service to:

• Bypass payment or licensing mechanisms.
• Manipulate prices or checkout requests.
• Use stolen, fraudulent, or unauthorized payment methods.
• Exploit vulnerabilities in the Website, APIs, delivery system, or other infrastructure.
• Attempt to gain unauthorized access to another user's Account.
• Circumvent download limits, authentication, or other access controls.
• Share or distribute one-time or otherwise restricted download links.
• Attack, overload, disrupt, or interfere with the Service.
• Reverse engineer the Service for the purpose of circumventing security or access controls.
• Engage in any activity that violates applicable law or the rights of another person.

If you believe that a Purchase was made without your authorization or that there is a problem with a Purchase, please contact us so that we can attempt to resolve the issue.

You must not initiate a fraudulent or intentionally misleading chargeback or payment dispute.

Fraudulent or abusive payment disputes may result in suspension or termination of your Account and revocation of access to purchased Products, to the extent permitted by applicable law.

Nothing in these Terms prevents you from exercising rights available to you under applicable law or applicable payment-provider policies.

Payments processed through external gateways may also be subject to gateways' own terms, dispute procedures, and applicable buyer-protection policies.

Rarecandy relies on third-party services, including Discord and PayPal, to provide certain functionality.

Your use of such services is subject to their respective terms and policies.

We do not control third-party services and are not responsible for changes, outages, suspensions, account actions, security incidents, or other events caused by those services.

In particular, suspension or termination of your Discord Account may prevent you from accessing Rarecandy features or receiving Products.

We do not guarantee that the Service will always be available, uninterrupted, secure, or error-free.

We may modify, suspend, or discontinue any part of the Service at any time.

Products may be updated, replaced, discontinued, or removed from the Website.

Where technically feasible, licenses for previously purchased Products will remain available after a Product is removed from the store. However, we do not guarantee indefinite availability of every previous version, download method, compatibility target, or third-party dependency.

Products may depend on third-party software, platforms, Minecraft versions, loaders, APIs, libraries, or other technologies.

We do not guarantee that a Product will remain compatible with every future version of such software.

Unless explicitly stated otherwise, compatibility with future versions is not guaranteed.

Product updates may be provided at our discretion and may not be available indefinitely.

To the maximum extent permitted by applicable law, the Service and Products are provided on an "as is" and "as available" basis.

We do not guarantee that the Service or any Product will be uninterrupted, error-free, completely secure, or compatible with every environment.

Nothing in these Terms excludes or limits any warranty, right, or remedy that cannot legally be excluded or limited under applicable law.

To the maximum extent permitted by applicable law, Rarecandy will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to your use of the Service or Products.

This includes, where legally permitted, loss of profits, revenue, data, server availability, business opportunities, or other intangible losses.

Nothing in these Terms limits liability where such limitation is prohibited by applicable law.

To the maximum extent permitted by applicable law, you agree to indemnify and hold harmless Rarecandy and its operators, contributors, and representatives from claims, liabilities, damages, losses, and expenses arising from:

• Your violation of these Terms.
• Your misuse of the Service or Products.
• Your violation of applicable law.
• Your violation of the rights of another person or entity.

We may suspend or terminate your access to the Service if you violate these Terms, engage in fraud or abuse, distribute Products without authorization, or otherwise misuse the Service.

Upon termination, your license to use Products may be revoked where the termination results from your violation of these Terms.

Sections concerning intellectual property, prohibited conduct, payment disputes, disclaimers, limitations of liability, indemnification, and any other provisions that by their nature should survive termination will continue to apply.

We may update these Terms from time to time.

When we make changes, we may update the "Last updated" date at the beginning of these Terms.

Your continued use of the Service after revised Terms become effective constitutes acceptance of the revised Terms, to the extent permitted by applicable law.

If a change materially affects your rights or obligations, we may provide additional notice where appropriate.

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted by law and the remaining provisions will continue in full force and effect.

Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce that provision or any other provision in the future.

These Terms, together with the Privacy Policy and any Product-specific license terms expressly incorporated into these Terms, constitute the entire agreement between you and Rarecandy concerning your use of the Service and supersede prior agreements or understandings concerning the same subject matter.

These Terms shall be governed by and interpreted in accordance with the laws applicable to Rarecandy and its operator, without regard to conflict-of-law principles.

Any dispute arising from or relating to these Terms or the Service shall be handled through the dispute-resolution mechanisms available under applicable law.

Nothing in this section prevents a consumer from exercising mandatory rights or remedies available under the laws applicable to them.
